These Terms of Service, together with any policies or rules referenced here, govern your access to and use of Lemonil, including our website, mobile applications, and related services (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Lemonil is a neighborhood fruit review service. Users can discover, rate, review, and share photos and other content about fruits, fruit sellers, and fruit-related experiences in their area. The Services may also include listings, recommendations, location-aware features, messaging, and other related tools that may change over time.
You must have the legal capacity to enter into these Terms. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian where required by law. You may not use the Services if we have previously suspended or banned you, or if doing so would violate any applicable law or agreement.
Some features may require an account. You agree to provide accurate information, keep it up to date, and protect your login credentials. You are responsible for all activity that occurs through your account. You must notify us promptly if you suspect unauthorized access.
We may update these Terms or change, suspend, or discontinue the Services at any time. If we make material changes, we may notify you by posting the updated Terms, sending a notice through the Services, or using another reasonable method. Your continued use of the Services after a change becomes effective means you accept the updated Terms.
We may also add new features, remove features, or limit access to certain features for some users. Not all features will be available to all users at all times.
Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that you have reviewed that policy. If you access the Services from outside your home country, you understand that your information may be processed in the United States or other countries where we or our service providers operate.
The Services may allow you to submit reviews, ratings, photos, comments, messages, suggestions, and other content (collectively, "User Content"). You remain responsible for your User Content, including any claims, risks, or consequences that arise from posting it.
You represent that you own or have the rights needed to submit your User Content and to grant us the rights described in these Terms. You also represent that your User Content will be honest, lawful, and not misleading. Do not submit fake reviews, paid endorsements, manipulated ratings, or content that you know is false, defamatory, harassing, hateful, unlawful, or otherwise harmful.
You grant Lemonil a worldwide, non-exclusive, royalty-free, transferable, sublicensable, and perpetual license to host, store, reproduce, display, publish, adapt, modify, translate, analyze, distribute, and otherwise use your User Content in connection with operating, improving, promoting, and securing the Services. This license includes the right to use your username, profile image, and any other associated identifiers to the extent reasonably necessary to display your User Content or operate the Services.
We may use suggestions, ideas, or other feedback you provide for any purpose without compensation or obligation to you.
Lemonil is designed for local discovery, which means some content may be location-based or neighborhood-specific. You understand that fruit quality, freshness, availability, and seller behavior may vary over time, by season, and by location. Reviews reflect a user's subjective experience and may not reflect every user's experience.
You should use your own judgment when relying on reviews, recommendations, ratings, photos, or other content on the Services. We do not guarantee that any review is accurate, complete, current, unbiased, or representative of a fruit, seller, or location.
You agree not to misuse the Services. Without limiting that obligation, you will not:

We may review, screen, remove, edit, label, reorder, restrict, or restore content at our discretion, with or without notice. We may also limit the visibility of content that appears misleading, abusive, repetitive, off-topic, spammy, unsafe, or otherwise inconsistent with the purpose of the Services.
We do not independently verify every user, review, photo, neighborhood claim, or listing. You are responsible for interacting safely with other users and for using caution whenever you meet someone in person, visit a new location, or rely on information from the Services.
The Services may include links to third-party websites, maps, payment services, social platforms, or other third-party content. We do not control or endorse third-party content or services and are not responsible for their availability, accuracy, or practices. Your use of any third-party content or services is at your own risk and may be subject to separate terms and policies.
We and our licensors own the Services, including our software, design, branding, and other proprietary content, except for User Content. You may not copy, modify, distribute, publicly display, or create derivative works from our proprietary materials except as expressly allowed by these Terms or by law.
If you believe content on the Services infringes your rights, contact us using the information below so we can review the issue.
We may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. We are not liable for outages, delays, maintenance, data loss, or other issues that arise from downtime or service interruptions.
Nothing in these Terms obligates us to maintain, support, or continue any particular feature or version of the Services.
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk or possible legal exposure for us or others, or misused the Services. You may stop using the Services at any time. Sections that by their nature should survive termination will continue to apply.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES, ANY CONTENT, OR ANY THIRD-PARTY MATERIALS WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICES AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, LEMONIL AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Lemonil and our affiliates, officers, directors, employees, agents, and partners from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your User Content, your breach of these Terms, or your violation of any law or third-party right.
By using the Services, you consent to receive notices, disclosures, agreements, and other communications electronically. You agree that electronic signatures, records, and delivery satisfy any legal requirement that such communications be in writing.
These Terms and any dispute arising from them or your use of the Services are governed by the laws of the State of Washington, except to the extent preempted by U.S. federal law, without regard to conflict-of-law principles. Any dispute that is not subject to arbitration or cannot be heard in small claims court must be brought in the state or federal courts located in King County, Washington, and you consent to that venue and jurisdiction.
Before starting formal proceedings, the parties agree to try to resolve a dispute informally for at least 30 days after written notice. If the dispute is not resolved, it will be resolved by binding arbitration on an individual basis, unless the parties agree otherwise or the dispute qualifies for a legal exception that cannot be arbitrated.
You waive any right to participate in a class, collective, or representative proceeding to the fullest extent permitted by law.
These Terms are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them without restriction.
No joint venture, partnership, employment, agency, or fiduciary relationship is created by these Terms or by your use of the Services.
